Introduction

These Terms of Service ("Terms") govern your access to and use of the ConceptDiagram website at https://conceptdiagram.com and our related services (collectively, the "Service"). ConceptDiagram ("ConceptDiagram", "we", "us", or "our") is the operator of the Service.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Description of the Service

ConceptDiagram is an AI-powered diagramming tool that generates concept maps, flowcharts, mind maps, and scientific illustrations from text descriptions you provide. The Service is intended to support learning, teaching, and research. Because diagrams are generated by AI, output may contain inaccuracies or errors, and you are responsible for reviewing and verifying any output before relying on it.

Eligibility and Accounts

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. When you create an account, you agree to provide accurate and complete information and to keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly at support@conceptdiagram.com if you suspect any unauthorized use.

Acceptable Use

You agree not to:

• Use the Service in any way that violates any applicable law or regulation
• Submit content, or generate diagrams, that is unlawful, infringing, defamatory, or that violates the rights of others
• Attempt to gain unauthorized access to the Service, other users' accounts, or our systems and networks
• Interfere with or disrupt the integrity or performance of the Service, including by introducing malware or other harmful code
• Use automated means to scrape, overload, or abuse the Service, or attempt to circumvent usage limits or credit allocations
• Resell, sublicense, or commercially exploit the Service except as expressly permitted

Intellectual Property

Your Content and Diagrams

You retain full ownership of the text prompts you submit and the diagrams you generate using the Service. The diagrams you create are yours: you are free to use, modify, publish, share, and distribute them for any lawful purpose, including commercial use, without attribution to ConceptDiagram.

You grant us a limited, non-exclusive license to host, store, process, and display your content solely as necessary to operate and provide the Service to you. You are responsible for ensuring that your prompts and resulting diagrams do not infringe the rights of any third party.

Our Intellectual Property

The Service itself, including the website, software, design, branding, and all related features and functionality (excluding your content and generated diagrams), is owned by ConceptDiagram and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use our trademarks or branding without our prior written permission.

Subscriptions, Credits, and Billing

The Service is offered through subscription plans (Starter, Pro, and Max, available on monthly or annual billing) and one-time credit packs (Starter Pack, Creator Pack, and Studio Pack). Payments are processed by our payment provider, Stripe.

• Subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current rate until canceled. You may cancel at any time, and cancellation takes effect at the end of the current billing period. You will retain access for the remainder of the period you have paid for.
• Credit Packs are one-time purchases that add diagram-generation credits to your account. Credits are consumed as you generate diagrams.
• You authorize us and Stripe to charge your payment method for all applicable fees and taxes. You are responsible for keeping your payment details current.
• We may change our prices from time to time. Price changes to subscriptions will apply from your next billing period, and we will provide reasonable advance notice where required.

Refund Policy

Because the Service delivers digital products that are generated and consumed on demand, the following refund terms apply:

• Credit Packs: Credit packs are non-refundable once any credit from the pack has been used. If you have not used any credits from a pack, you may request a full refund within 14 days of purchase by contacting support@conceptdiagram.com.
• Subscriptions: Subscription fees are generally non-refundable for periods that have already begun. If you cancel, you will retain access until the end of your current billing period, and you will not be charged for subsequent periods. If you were charged in error or experienced a significant technical failure that prevented you from using the Service, contact us within 14 days of the charge and we will review your request in good faith.
• Refunds, where granted, are issued to your original payment method via Stripe.
• Nothing in this policy limits any non-waivable statutory refund or cancellation rights you may have under applicable consumer protection laws.

Service Availability and Changes

We strive to keep the Service available but do not guarantee that it will be uninterrupted, timely, secure, or error-free. We may modify, suspend, or discontinue any part of the Service at any time. We may also introduce, change, or remove features and usage limits.

Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated diagrams will be accurate, complete, or suitable for any particular purpose. You use the Service and rely on its output at your own risk.

Limitation of Liability

To the maximum extent permitted by law, in no event shall ConceptDiagram be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Service. Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the greater of the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or USD 100.

Indemnification

You agree to indemnify and hold harmless ConceptDiagram and its officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of your use of the Service, your content, or your violation of these Terms.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws applicable at the operator's principal place of business, without regard to conflict of laws principles.

If a dispute arises out of or relates to these Terms or the Service, you agree to first contact us at support@conceptdiagram.com and attempt to resolve the matter informally through good-faith negotiation. If the dispute cannot be resolved amicably within a reasonable period, the parties agree to seek resolution through binding arbitration or another mutually agreed dispute resolution mechanism, conducted on an individual basis, to the extent permitted by applicable law. Nothing in this section limits any non-waivable rights you may have under the mandatory laws of your place of residence.

Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
